On December 5, 2024, Mr. Streza obtained a defense verdict (9-3) following a trial that spanned 5 weeks in Sonoma County. The case involved a claim for traumatic brain injury and resulting disability arising from a swing arm bar falling and striking the plaintiff Laura McCombs in the head. The blow knocked the plaintiff unconscious. Plaintiff was a visitor to defendants’ commercial property in Rohnert Park when the incident occurred. Plaintiff sued the defendants claiming that they were liable for a dangerous condition on the property. In addition, plaintiff alleged that the defendants were in violation of OSHA regulations in connection with the incident and obtained a “negligence per se” instruction. Defendants disputed liability for the incident as well as the alleged injuries and damages. During the trial, the jury heard testimony from numerous medical experts including neuropsychologists, neurologists, neuroradiologists, as well as others. Plaintiff sought damages for her injuries, including future treatment and loss of future earning capacity. Prior to trial, the parties exchanged CCP 998 offers, with the defense making offers of $50,000 later increased to $121,007.25. At trial, the plaintiff asked for an award of over $1.9 million. The jury found for the defense.
